1. Acceptance of Terms

By downloading, installing, or using DeepBreath (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Medical Disclaimer

DeepBreath is NOT a substitute for professional medical care. The App provides:

• Guided breathing exercises
• Grounding and body scan techniques
• Panic episode logging for personal tracking

The App does NOT provide:

• Medical diagnosis or treatment
• Therapy or counseling services
• Emergency crisis intervention
• Advice from licensed healthcare professionals

When to Seek Professional Help

You should consult a licensed mental health professional if:

• You experience frequent or severe panic attacks
• Your anxiety interferes with daily life
• You have thoughts of self-harm or suicide
• You need medication or clinical therapy

In a medical emergency, call 911 (US), 112 (EU), or your local emergency number immediately.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use DeepBreath for personal, non-commercial use on your iPhone. You may not copy, modify, distribute, sell, or reverse engineer the App.

4. Premium Subscriptions

Free vs. Premium

DeepBreath offers a free tier with limited features and optional paid subscriptions:

• Free: 3 SOS sessions, limited breathing patterns, basic grounding, limited panic log
• Premium: Unlimited access to all features, patterns, full panic log, HealthKit integration, PDF export

Subscription Terms

• Subscriptions are processed through Apple's App Store and governed by Apple's Terms of Service
• Weekly subscription: $4.99/week, auto-renews weekly
• Annual subscription: $39.99/year, auto-renews annually, includes 3-day free trial
• Lifetime purchase: $79.99 one-time payment, no renewal

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Manage or cancel subscriptions in iPhone Settings → Your Name → Subscriptions.

Refunds

All purchases are processed through Apple. Refund requests must be submitted to Apple via the App Store. We do not process refunds directly. Apple's refund policy applies.

5. User Responsibilities

You agree to:

• Use the App in a safe environment (not while driving, operating machinery, etc.)
• Not rely on the App as a substitute for professional medical care
• Seek emergency help if you experience a medical crisis
• Not share your Apple ID or subscription with others

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR SPECIFIC NEEDS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER DIRECT OR INDIRECT, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any reliance on the App for medical treatment
• Errors, bugs, or technical issues in the App
• Unauthorized access to or alteration of your data

8. Apple HealthKit

If you enable HealthKit integration, DeepBreath writes "Mindful Minutes" data to Apple Health. You may revoke this permission at any time in iPhone Settings. We do not access, store, or transmit your HealthKit data to any server. Apple's HealthKit Terms apply.

9. Data and Privacy

Your use of the App is subject to our Privacy Policy, available at deepbreath.evtsoy.com/privacy. In summary: we do not collect or store your personal data. All app data stays on your device.

10. Intellectual Property

All content in the App — including text, graphics, code, breathing patterns, grounding scripts, and design — is owned by us and protected by copyright and intellectual property laws. You may not copy, reproduce, or create derivative works without written permission.

11. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. Some updates may be delivered via over-the-air (OTA) updates without requiring an App Store download. We may also update these Terms. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause, if we believe you have violated these Terms. Upon termination, you must delete the App from your device. Subscriptions remain subject to Apple's refund policy.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.
